5. Subscription and Payment

5.1 Free Plan

We offer a free plan with limited features. Free accounts are subject to usage restrictions as described on our pricing page.

5.2 Paid Plans

Paid subscriptions provide access to additional features and higher usage limits. By subscribing to a paid plan:

• You authorize us to charge the payment method provided for the subscription fee.
• Subscriptions are billed on a recurring basis (monthly or annually) until cancelled.
• Prices are displayed in EUR and include applicable taxes.

5.3 Payment Processing

Payments are processed through PayPal. By making a purchase, you agree to PayPal's terms of service. We do not store your payment card information.

5.4 Refunds and Cancellations

In accordance with French consumer law and EU regulations:

• You have a 14-day right of withdrawal from the date of purchase for digital services, unless you have expressly consented to the immediate provision of the service and acknowledged that you will lose your right of withdrawal.
• To request a refund, contact us at contact@chartswork.com within the withdrawal period.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial subscription periods after the withdrawal period.

6. User Content

6.1 Ownership

You retain all ownership rights to the Content you create using our Services. We do not claim ownership over your charts or data.

6.2 License Grant

By using our Services, you grant ChartsWork a limited, non-exclusive, worldwide license to store, process, and display your Content solely for the purpose of providing the Services to you.

6.3 Content Responsibility

You are solely responsible for your Content. You agree not to:

• Upload content that infringes intellectual property rights
• Create charts containing illegal, harmful, or offensive material
• Use the Services to mislead or deceive others with false data
• Share content that violates any applicable laws or regulations

7. Acceptable Use

When using our Services, you agree not to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the Services
• Use automated means to access the Services without permission
• Reverse engineer, decompile, or disassemble any part of our software
• Resell, sublicense, or redistribute the Services
• Use the Services for any fraudulent or malicious purpose

The ChartsWork platform, including its design, features, code, and branding, is protected by intellectual property laws. All rights not expressly granted are reserved.

• The ChartsWork name, logo, and trademarks are our exclusive property.
• You may not copy, modify, or distribute our software or platform.
• Charts created with ChartsWork may include our branding (free plan) or be watermark-free (paid plans).

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, except as required by applicable law.

• We do not guarantee uninterrupted or error-free operation of the Services.
• We are not responsible for the accuracy of data you input into the Services.
• Charts created using financial data are for informational purposes only and do not constitute financial advice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ChartsWork shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from unauthorized access to your account
• Any interruption or cessation of the Services

Our total liability for any claims arising from these Terms or your use of the Services is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold ChartsWork harmless from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your Content or data
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your access to the Services at any time if:

• Your account shows no activity for an extended period

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Services will immediately cease.
